Marriage Registration : Required Documents and Procedure

Marriage is one of the most important events in a person’s life, and its legal registration is significant. Marriage registration in Maharashtra is more than simply a legal requirement; it is also an important document for claiming rights, receiving government benefits, and participating in numerous judicial proceedings.

This article discusses the major parts of the marriage registration procedure, including the necessary documents, applicable legislation, common issues, and solutions.

The Post-Marriage Registration Process

In Maharashtra, couples must register their marriage once it has been solemnized by submitting an application either online via https://aaplesarkar.mahaonline.gov.in/ or offline at the local registration office. The bride and groom or their representatives can file the application at the registrar’s office where the marriage took place or where either of them lives.

The required documents include:

Photographs and identification proofs (Aadhaar, voter ID, etc.)

Proof of age (Birth Certificate or School Leaving Certificate)

Residence evidence (ration card, utility bill, passport)

Marriage invitation or document (if not available)

Divorce decree or death certificate (if any)

Photographs of the couple together and with witnesses

The Registrar of Marriages (available at municipal or panchayat level) is in charge of inspecting paperwork and approving registrations. The applicable fees vary depending on the date of the application.

Pay रु. 50 within 90 days.

रु.100 from 90 days to 1 year.

रु. 200 after one year.

Document verification requires an appointment with the couple and witnesses present.  Following approval, a digital marriage certificate is issued and sent via email/SMS.  In the event of denial, an appeal may be lodged with the State Registrar and, if necessary, the District Court.  Form J stores all records digitally.

Registration under the Special Marriage Act, 1954

The Special Marriage Act establishes the legal foundation for interfaith and intercaste marriages. It is a secular regulation that applies to all religions and allows people of all faiths or castes to legally register their marriages.

Registration Procedure under the Act:

  1. The couple must submit an application online through https://adjudication.igrmaharashtra.gov.in/eMarriage2.0/ or at the district registrar’s office.
  2. Include documentation such as evidence of age, identification, address, and witness information.
  3. A public notice is issued and exhibited for 30 days, allowing for any complaints.
  4. If any objections are raised, the registrar will consider them and make an appropriate decision.
  5. At least two witnesses must be present for verification.
  6. Following verification and approval, a legal marriage certificate is provided.

The Special Marriage Act provides legal protection and acknowledgment for interfaith and intercaste marriages, which is particularly significant in varied societies.

Important areas in the marriage registration process

1. Document Readiness: Accurate and thorough documentation facilitates a smooth registration process. These contain birth certificates, ID proofs, and witness information.

2.Timely submission: Delays in applying may result in additional expenses or legal difficulties.  It is critical to submit your application by the deadline.

3.The Importance of Witnesses: Witnesses validate the marriage and must provide identification.  Their presence and genuineness are crucial.

Common Challenges and Solutions

  1. Incomplete Documents: Missing documentation can cause registration to be delayed or blocked.  Always keep a checklist and make replacements as needed (for example, apply for a missing birth certificate).
  2. Errors in the application: Form submission errors can result in rejections. Double-check your information and carefully follow the gateway instructions. If you’re unsure, seek guidance from local authorities.
  3. Missed Deadlines: Delay in applying may result in penalty.  In such circumstances, provide an affidavit explaining the delay.
  4. Language Barriers: Some applicants may struggle to use English-only portals. Visit the local office for regional language assistance or seek legal counsel.
  5. Witness Unavailability: Registration cannot proceed without witnesses. Prepare backups ahead of time.
  6. Confusion Regarding Applicable Law: Different religions have different laws.  For interfaith marriages, the Special Marriage Act should be employed.
  7. Fraudulent intermediaries: Avoid unofficial agents. Only use government portals or go straight to the registrar’s office.
  8. Delayed Certificate Issue: Keep track of your application and store the application number safely.  Contact the office or download via the site.
  9. Corrections to Certificate: If the granted certificate has errors, apply in writing for correction with supporting documentation and an affidavit.
